  • If an applicant marks yes on the felony question these are the steps for them to proceed with so their application can be reviewed by the FCC properly.
  • It is not appropriate for any VE within SANDARC to ask about the circumstances regarding the felony the applicant has indicated yes to on the 605; it is only allowable to explain the process of submitting the statement. An applicant may offer up details of their information, but it is not the place of any VE to dig further into that information. Any deviation from this policy that is reported to the VEC will result in SANDARC placing the VE under review for possible revocation of their accreditation.
  • After a session is submitted with an applicant that marks yes to the felony question the applicant has a 14-day period to submit a statement to the FCC about why they believe they should be granted a license.
  • There are no set guidelines of information that need to exist in the explanation but some useful stuff would be:

  • List all felony charges of which you were convicted (this part is mandatory)

  • A detailed description of the conduct that resulted in the conviction or guilty plea, including time and place
  • The date of the conviction or guilty plea
  • The punishment that was imposed, and whether the sentence has been completed, or the applicant is still under any restriction or condition resulting from the conviction or guilty plea
  • Any efforts taken to remedy the wrongs committed and ensure that the applicant will not engage in such conduct in the future.

Steps for Applicant

  1. Applicant will need to find their application number as it MUST be included in the statement to the FCC and it can be found using the FCC ULS Advanced Application Search
  2. Applicant will need to email their explanation to attach605@fcc.gov.
  3. Wait for the FCC to make a decision....There is no set minimum or maximum amount of time they can take to make this determination so sit back and wait.
